These Terms and Conditions ("Agreement") govern the use of M/s. Pincode Professional Services ("referred as the Company") with its brand identity “PostalCode Pro” along with web portal www.postalcodepro.com and mobile app as PostalCode Pro (referred as "the Platform"), by accessing or using the platform, you agree to be bound by this agreement. If you do not agree with these terms, please refrain from using this platform.
1. Description of Services
Pincode Professional Services operates an online platform which facilitates the connection between users seeking individual service providers and professionals within their pincode and also act as service providers themselves. The Company provides contact details of relevant service providers based on user requirements and postal codes.
2. User Responsibilities
2.1 User Accounts: Users are responsible for maintaining the confidentiality of their account information and passwords. Any activity performed using the user's account will be deemed their responsibility.
2.2 Accurate Information: Users must provide accurate and up-to-date information when using the Platform, including their contact details and service requirements.
2.3 Prohibited Conduct: Users must not engage in any activity that is unlawful, abusive, fraudulent, or interferes with the proper functioning of the Platform or the rights of others.
3. Service Providers
3.1 Verification: The Company strives to maintain accurate and reliable information about service providers /professionals listed on the platform. However, the company does not guarantee the accuracy or completeness of the information provided by service providers/ professionals. Users are advised to conduct their own due diligence or necessary paper work before engaging any service provider at their own expenses and avail services at their own risk.
3.2 Relationship with Service Providers: The Company does not employ or endorse service providers listed on the Platform. The relationship between the user and the service provider / professionals is independent and outside the scope of this Agreement.
4. Fees and Payments
4.1 Pricing: Pincode Professional services is not involved in taking any payments / does not charge any money or payment on behalf of any service provider / professional or client who wants to avail/ hire the service. The company charges a one time fee in the form of consultancy to connect the end user with the service provider / professional OR service provider / service professional with the client. The pricing details are specified on the platform while connecting with each other, these charges are subject to change as per discretion of the company. End users and service providers are free to connect with people of the choice of service providers and clients along with their agreed quotation between them and solely responsible for any applicable taxes or additional charges associated with the services provided by service providers / professionals to the client.
4.2 Payment Processing: The Company may use third-party payment processors to facilitate payments. Users must comply with the terms and conditions of these payment processors when making payments through the platform.
5. Intellectual Property
5.1 Ownership: The Company retains all intellectual property rights associated with the Platform, including but not limited to trademarks, logos, and copyrighted content.
5.2 Limited License: Users are granted a limited, non-exclusive, and non-transferable license to access and use the Platform for their personal or business purposes. Users must not reproduce, modify, distribute, or exploit any part of the Platform without prior written consent from the Company.
6. Limitation of Liability
6.1 Disclaimer: The Company does not guarantee the suitability, reliability, or availability of the services provided by service providers listed on the Platform. Users acknowledge that the use of the Platform is at their own will.
6.2 Indemnification: Users agree to indemnify and hold the Company, its directors, employees, and affiliates harmless from any claims, damages, or liabilities arising from their use of the Platform or their interactions with service providers.
7. Privacy Policy
The Company's Privacy Policy governs the collection, use, and disclosure of personal information provided by users. By using the Platform, you agree to the terms outlined in the Privacy Policy.
8. Modifications to the Agreement
The Company reserves the right to modify or update this agreement at any time. Users may or may not be notified of any significant changes via email or through the Platform notifications. Continued use of the Platform after such modifications signifies acceptance of the updated Agreement.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising in the courts of Mumbai, Maharashtra. India
